Welcome to Feng Shui Chic ("we" or "us" or the "Company"). By using the Website, you accept and agree to be bound and abide by these Terms of Service. This document includes a Privacy Policy available at fengshuichic.com/privacy-policy. Users must read carefully before accessing the service.
Feng Shui Chic reserves the right to update the website and terms from time to time, at our discretion and without notice. Changes are publicly posted, and continued use indicates acceptance of modifications.
The company cannot guarantee 24/7 availability and reserves the right to suspend or restrict access to some features to users. Users must maintain confidential registration information and use strong passwords. All the information you provide on the Website must be correct, current, and complete. The site manages personal data per the Privacy Policy.
Information delivered by Feng Shui Chic's products and features should be used with common sense. The service is a work in progress and does not warrant absolute accuracy of the backend service for I-Ching or Feng Shui reports.
By paying the service fee, you confirm authorization to make the purchase using your payment method. All prices stated on the Feng Shui Chic Websites are inclusive of any applicable sales taxes and fees.
The company may change prices for paid services, effective after the current billing period expires. Any price change will be communicated to you at least 14 days in advance. Continued use after notification means acceptance.
Subscriptions will automatically renew at the end of each subscription term unless you terminate your subscription per Section 9. Renewals default to monthly billing with automatic charging.
Your use of Feng Shui Chic is at your sole risk. The service is provided "as is" and "as available." The company disclaims all warranties and is not liable for damages. Users agree to defend, indemnify, and hold us harmless from any claims.
The agreement becomes effective upon account creation and continues until terminated. Users may cancel paid subscriptions anytime, with termination effective at the end of the current billing period. Feng Shui Chic will not refund any remaining portion of subscription fees you have already paid for. The company may terminate accounts for unauthorized use.
The Feng Shui Chic Service and the content provided through the Feng Shui Chic Service is the property of Feng Shui Chic or Feng Shui Chic's licensors and is protected by copyright. Users must not infringe third-party intellectual property rights.
Copyright holders believing infringement exists should contact: Feng Shui Chic, Attn: Legal Department, Copyright Agent, Houston, Texas, via the Contact page. Notices must include specific work identification, location description with URL, complainant contact information, and statements regarding good-faith belief and accuracy under penalty of perjury.
The company makes reasonable efforts to keep the Feng Shui Chic Service operational but reserves the right to modify or discontinue, temporarily or permanently, functions and features with or without notice.
Feng Shui Chic may assign this Agreement or any part of it without restrictions. You may not assign this Agreement or any part of it to any third party.
The agreement and Privacy Policy constitute all the terms and conditions agreed upon between you and Feng Shui Chic and supersede prior agreements. Additional or different terms from user communications are void.
If any provision becomes invalid or unenforceable, remaining provisions continue in effect.
Disputes arising out of or relating in any way to the Feng Shui Chic Service or your use thereof require mandatory binding arbitration under Federal Arbitration Act rules administered by the AAA. Exceptions exist for intellectual property claims and theft/piracy allegations, which are exclusively decided by Houston, Texas courts under Texas and Federal law.
YOU AND FENG SHUI CHIC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A CLASS MEMBER. Claims must commence within one year of discovery. The company covers excessive arbitration fees. Texas law governs exclusively, with Houston, Texas as sole venue.
If translated into other languages with discrepancies, the English language version shall prevail.
